Rubbish Collection Brent Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Brent provides rubbish removal and related waste collection services to residential and commercial customers in our service area. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms and Conditions, you should not use our services. You are advised to read this document carefully and to retain a copy for your records.

1. Definitions

In these Terms and Conditions, the following words have the meanings given:

Customer means the person, firm or company who requests or receives the services from Rubbish Collection Brent.

Services means any rubbish collection, waste removal, loading, transportation, disposal, recycling, clearance or related services provided by Rubbish Collection Brent.

Premises means the address or location where the Services are to be performed.

Waste means the items, materials, refuse or rubbish which the Customer asks us to remove.

Contract means the agreement between the Customer and Rubbish Collection Brent for the provision of the Services, comprising these Terms and Conditions and any quotation or booking confirmation.

2. Scope of Services

Rubbish Collection Brent provides rubbish collection and waste removal services within its defined service area. The specific services to be carried out will be as described in your quotation, booking confirmation, or as agreed in writing prior to the commencement of work.

Unless expressly agreed otherwise, the Services are limited to the removal of non-hazardous household, garden, office and general commercial waste that can be safely lifted and loaded by our operatives and transported in our vehicles in accordance with applicable laws and regulations.

We reserve the right to refuse to remove any items that we consider to be hazardous, unsafe to handle, excessively heavy or bulky, or not in accordance with relevant waste regulations or our licence conditions.

3. Booking Process

3.1 You may request a quotation or make a booking by telephone or by any other communication method we make available. When doing so, you must provide accurate and complete information about the type, approximate volume, and location of the waste to be collected, as well as any access issues at the Premises.

3.2 Any quotation provided by us is based on the information you supply. We reserve the right to revise the quotation or apply additional charges if, upon arrival at the Premises, the description, amount, or nature of the waste differs from that originally provided, or if there are access or parking issues that were not disclosed.

3.3 A booking will be confirmed when we accept your request and provide you with a date and either a time or time window for the collection. Acceptance may be given verbally or in writing. At this point, a Contract is formed between you and Rubbish Collection Brent subject to these Terms and Conditions.

3.4 All bookings are subject to availability. We aim to attend at the agreed date and time, but attendance times are estimates only and may be affected by traffic, previous jobs or circumstances beyond our reasonable control.

4. Access, Parking and Customer Obligations

4.1 You must ensure that our operatives have safe, reasonable and lawful access to the Premises at the agreed time. This includes arranging any necessary permissions for entry, parking or access through communal areas or controlled zones.

4.2 You are responsible for providing accurate directions and any relevant instructions regarding access, including building entry systems, gates, loading restrictions or time limits.

4.3 You must ensure that the area where the Services will be carried out is safe, free from undue hazards, and compliant with health and safety requirements. We may refuse to undertake or continue work if, in our reasonable opinion, conditions at the Premises are unsafe for our operatives.

4.4 Where permits or paid parking are required, it is your responsibility to provide or arrange these unless agreed otherwise in advance. Any parking fines or penalties incurred as a result of your failure to provide suitable parking or instructions may be charged to you.

5. Waste Types and Prohibited Items

5.1 You must clearly identify any items that may require special handling. We do not ordinarily collect hazardous or specialist waste, including but not limited to asbestos, clinical and medical waste, chemicals, solvents, oils, fuels, gas bottles, radioactive materials, explosives, or any other material that is classified as hazardous under applicable waste regulations.

5.2 We may also refuse to remove items that present a health and safety risk, that cannot be moved without specialist equipment, or that exceed reasonable manual handling limits for our operatives.

5.3 You warrant that the waste presented for collection is your own property or that you have full authority of the owner to dispose of it. You are responsible for ensuring that no items of value or items that you intend to keep are included in the waste presented for removal.

5.4 Once the waste has been loaded into our vehicle and we have left the Premises, it cannot be retrieved or returned.

6. Pricing and Payment

6.1 Our charges are generally based on one or more of volume, weight, labour time, type of waste, and any additional services requested. The basis of your charge will be explained at the quotation stage.

6.2 Unless otherwise agreed in advance, payment is due in full upon completion of the Services on the day of collection. We may require a deposit or full prepayment for certain bookings at our discretion.

6.3 We accept payment by the methods notified to you at the time of booking or completion. You agree to provide accurate billing details and to ensure that payment can be processed at the required time.

6.4 All prices quoted are exclusive of any applicable taxes or statutory charges, which will be added where required by law.

6.5 If you fail to make payment when due, we may charge interest on the outstanding amount at the statutory rate and recover all reasonable costs incurred in recovering the debt, including legal costs and collection agency fees.

7. Cancellations, Rescheduling and Waiting Time

7.1 You may cancel or reschedule your booking by contacting us during our normal office hours. Cancellations or changes made with at least 24 hours notice before the scheduled attendance time will normally be free of charge.

7.2 We reserve the right to charge a cancellation fee if you cancel or significantly change your booking with less than 24 hours notice, if our operatives attend the Premises and are unable to gain access, or if you fail to be present (where your presence is required) during the agreed time window.

7.3 Where our operatives are kept waiting beyond a reasonable period due to access issues, incomplete preparation of waste, or other delays within your control, we reserve the right to charge waiting time at our then current rates.

7.4 We may cancel or reschedule the Services if we are unable to attend due to events beyond our reasonable control, including but not limited to extreme weather, vehicle breakdown, accidents, road closures, or staff illness. In such cases, we will notify you as soon as reasonably practicable and arrange an alternative appointment. We will not be liable for any loss arising from such cancellation or delay, but any prepayments for services not carried out will be refunded or applied to the rearranged booking.

8. Customer Preparation and Service Limitations

8.1 Unless otherwise agreed, you are responsible for ensuring that the waste is reasonably accessible and ready for collection. This may include bagging small loose items, grouping items together, and making sure that bulky items are dismantled where necessary to allow safe removal.

8.2 We will take reasonable care when removing items from inside or around your property; however, you are responsible for protecting floors, walls, fixtures, and fittings, and for moving any delicate items that may be damaged during normal handling operations.

8.3 Our operatives may, at their discretion, assist with basic light dismantling of items to facilitate removal, but this is not guaranteed and will always be subject to health and safety considerations and time constraints.

8.4 We are not responsible for cleaning, sweeping or tidying areas beyond a basic removal of the waste. If you require additional clearance or cleaning services, this must be agreed in advance and may be subject to additional charges.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Services. If we damage your property as a direct result of our negligence, we will at our option repair the damage or pay you fair compensation, subject to the limitations below.

9.2 Our total liability to you for any loss or damage arising out of or in connection with the Contract, whether in contract, tort (including negligence) or otherwise, shall be limited to the total price paid or payable by you for the Services giving rise to the claim.

9.3 We shall not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of opportunity, or loss of goodwill, whether foreseeable or not.

9.4 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to exclude or limit liability.

9.5 You are responsible for checking that no items intended to be retained have been mixed with the waste for disposal. We accept no liability for any loss of items that you did not intend to discard once they have been removed and disposed of in the normal course of providing the Services.

10. Compliance with Waste Regulations

10.1 Rubbish Collection Brent operates in accordance with applicable UK waste management legislation and regulations. We will transport and dispose of waste only at authorised facilities and in line with our licences and regulatory obligations.

10.2 Where required by law, we will issue appropriate documentation or records to evidence the transfer and disposal of waste. You agree to provide any information reasonably requested by us to comply with legal or regulatory requirements concerning the classification or handling of waste.

10.3 You must not present for collection any controlled or hazardous waste unless we have expressly agreed in advance to handle such waste and are legally permitted to do so. If prohibited or misdescribed waste is discovered, we may refuse to remove it, return it to you, or arrange specialist disposal at your cost.

10.4 You agree to indemnify us for any fines, penalties, claims or costs arising from inaccurate or incomplete information that you provide regarding the nature or classification of the waste, or from your breach of waste-related laws or regulations.

11. Data Protection and Privacy

11.1 We will collect and process personal information about you for the purposes of administering your booking, providing the Services, processing payment, and complying with legal requirements.

11.2 We will handle your personal data in accordance with applicable data protection law. We will not sell your personal information to third parties. We may share information with trusted partners or service providers only where necessary to deliver the Services, process payments, or meet legal obligations.

11.3 You are responsible for ensuring that any contact and billing information you provide is accurate and kept up to date. You may request access to, or correction of, your personal data that we hold, subject to legal limitations.

12. Complaints and Disputes

12.1 If you have any concerns or are dissatisfied with any aspect of our Services, you should notify us as soon as possible, providing details of the issue and any supporting information.

12.2 We will investigate complaints in a fair and timely manner and will aim to resolve them by explanation, remedial action, or appropriate redress where a fault is identified.

12.3 If a dispute cannot be resolved informally, either party may pursue any legal remedies available under English law. Nothing in this clause affects your statutory rights.

13. Variations

13.1 We may amend these Terms and Conditions from time to time. Any changes will not affect existing Contracts that have already been formed, but will apply to future bookings and quotations from the date the revised terms are made available.

13.2 No variation to these Terms and Conditions shall be binding unless agreed in writing by an authorised representative of Rubbish Collection Brent.

14. Severability

14.1 If any provision or part-provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision or part-provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any Contract between you and Rubbish Collection Brent shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Contract, or the Services, including any non-contractual disputes or claims.
